Acceptance of these Terms

By signing up for, accessing or using Kraze, you confirm that you have the authority to accept these Terms on behalf of your organization, if applicable, and that you agree to be bound by them together with our Privacy Policy. If you do not agree, do not use Kraze.

About the service

Kraze is a software-as-a-service platform for people, time-tracking and leave management, including modules such as timesheets, projects and tasks, leave requests, and organization and role management, as made available to your plan.

Specific features, modules and limits depend on the subscription plan chosen by your organization and may be updated from time to time, as described on our pricing page.

Accounts and eligibility

Kraze is intended for use by businesses and organizations, and by individuals acting in a professional capacity on their behalf. You must provide accurate account information, keep your credentials confidential, and notify us promptly of any unauthorized use of your account.

An organization's account owners and administrators are responsible for managing access, roles and permissions for their own workspace members.

Customer data and responsibilities

"Customer data" means the data that your organization or its members submit to Kraze, including employee records, timesheets and leave data. As between you and us, your organization retains ownership of its customer data.

Your organization is responsible for the accuracy and lawfulness of the customer data it enters into Kraze, including having any necessary basis to process the personal data of its employees or workspace members, and for informing those individuals about the use of Kraze as described in our Privacy Policy.

Acceptable use

You agree not to use Kraze to:

• Violate any applicable law or the rights of others, including data protection and employment law;
• Upload or transmit malicious code, or attempt to gain unauthorized access to Kraze or its infrastructure;
• Reverse engineer, decompile or attempt to extract the source code of the platform, except where permitted by law;
• Resell, sublicense or make Kraze available to third parties outside your organization without our agreement;
• Interfere with the normal operation of the service or attempt to circumvent its usage limits or security controls.

Subscriptions, fees and billing

Paid plans are billed according to the pricing, billing cycle and payment terms presented at the time of purchase or in your order form. Fees are generally non-refundable except where required by law or expressly agreed.

We may change our pricing or plans for future billing periods; we will give you reasonable advance notice of any change that affects your subscription.

Intellectual property

novalogica and its licensors retain all rights, title and interest in and to the Kraze platform, including its software, design and trademarks. These Terms do not grant you any rights to our intellectual property other than the limited right to use Kraze in accordance with these Terms.

Your organization retains all rights to its customer data. We do not claim ownership of the data you submit to Kraze.

Service availability and support

We aim to keep Kraze available and reliable, but we do not guarantee uninterrupted or error-free operation. We may perform maintenance, or suspend access, where reasonably necessary for security, legal or operational reasons, and we will try to minimize disruption when we do.

Data protection

Our collection and use of personal data is described in our Privacy Policy, which forms part of these Terms. Where we process personal data on behalf of your organization as a processor, additional data-processing terms may apply and are available on request.

Confidentiality

Each party agrees to protect the other's confidential information with the same degree of care it uses for its own confidential information, and not to disclose it to third parties except as needed to perform the service or as required by law.

Limitation of liability

To the maximum extent permitted by applicable law, novalogica will not be liable for indirect, incidental or consequential damages arising from your use of Kraze. Nothing in these Terms limits liability that cannot be limited under applicable law.

Term and termination

These Terms apply for as long as you have an active account or subscription. Either party may terminate a subscription in accordance with the applicable order form or by closing the account, subject to any minimum term agreed.

On termination, we will make customer data available for export for a reasonable period, after which it may be deleted or anonymized in line with our data retention practices described in the Privacy Policy.

Governing law

These Terms are governed by the laws of Portugal, without prejudice to any mandatory consumer or data-protection rights you may have under the law of your place of residence.

Changes to these Terms

We may update these Terms from time to time. We will update the date at the top of this page when we do, and, for material changes, we will take reasonable steps to notify affected customers before the changes take effect.
